Please read these Terms of Service (“Terms”) carefully before using the PassionTrack mobile application (the “App”), operated by Prairiestone Appworks (“we,” “our,” or “us”). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Description of Service
PassionTrack is a personal tracking application that allows you to record and review your own stats and history entries. All data is entered by you and stored locally on your device.
2. Your Content
Entries, stats, and history you create in the App remain your own property and are stored locally on your device. We do not have access to this content, and it is not transmitted to us or any third party.
3. In-App Purchases
The App offers a free trial period, after which a one-time payment unlocks full functionality. All purchases are processed through the Google Play Store's billing system and are subject to Google Play's own terms and refund policies. We do not directly process or store your payment information.
4. Disclaimer of Warranties
The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including but not limited to accuracy, reliability, or fitness for a particular purpose. We do not guarantee the App will be error-free or uninterrupted.
5. Limitation of Liability
To the maximum extent permitted by law, Prairiestone Appworks shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data or loss of use, arising from your use of the App.
6. Changes to the App or These Terms
We may update the App or these Terms at any time. Continued use of the App after changes are posted constitutes acceptance of the revised Terms. Material changes will be reflected by an updated “Last updated” date above.
7. Governing Law
These Terms are governed by the laws of Saskatchewan, Canada, without regard to conflict of law principles.
